KEDUDUKAN HUKUM TENAGA KERJA KONTRAK PADA BADAN LAYANAN UMUM DAERAH RUMAH SAKIT UMUM dr. ZAINOEL ABIDIN BANDA ACEH

Abstract


Abstract, Article 33 (1) of the Government Regulation Number 23, 2005 regarding the Financial Management of Public Service Board states that Officials who are managers of the board and its officials may consist of civil servants and/or professional officials that are non-civil servants based on the need of the board that can be employed permanently or based on contract. In fact, practically, there are officials non civil servants of the Board discriminate and there is an inequal treatment of the local government compared to civil servants. The legal status of contracted employees at the Public Service Board of the Zainoel Abidin Public Hospital (RSUZA) Banda Aceh as contracted officials who are non-civil servants bound by working agreement in certain time and they are who are having functional official position. The existing of the work relationship is based on the regulation of State Official Act and Labor Act; hence there is possible that the violation towards the rights of contracted officials in regard with they are only bound for certain time and there is also cut of working relationship by one side. The protection forms preventively namely official status protection for contracted officials, protection on training and skill rights, protection on welfare, protection on strike right, and right to create workers union in defending colleagues rights and protection on fired action.

ABSTRAK, Pasal 33 ayat (1) Peraturan Pemerintah Nomor 23 Tahun 2005 tentang Pengelolaan Keuangan Badan Layanan Umum menyebutkan pejabat pengelola BLU dan pegawai BLU dapat terdiri dari pegawai negeri sipil dan/atau tenaga professional Non PNS sesuai dengan kebutuhan BLU, dimana tenaga professional non PNS tersebut dapat dipekerjakan secara tetap atau berdasarkan kontrak. Dalam praktik adanya pegawai non PNS BLUD menimbulkan diskriminasi dan kesewenang-wenangan pemerintah daerah dibandingkan dengan pegawai negeri sipil. Berdasarkan hasil penelitian diketahui pegawai kontrak pada BLUD Rumah Sakit Umum dr Zainoel Abidin Banda Aceh diikat melalui hubungan kerja dalam jangka waktu tertentu dan pegawai tetap non PNS yang memegang jabatan fungsional sesuai dengan keahliannya. Adanya hubungan kerja tersebut didasar pada ketentuan UU Kepegawaian dan UU Ketenagakerjaaan sehingga tidak menutup kemungkinan terjadi pelanggaran terhadap hak pegawai kontrak dari kemungkinan dilakukan pemutusan hubungan kerja secara sepihak. Bentuk perlindungan hukum secara preventif antara lain perlindungan atas status kepegawaian bagi tenaga kerja kontrak, perlindungan atas hak mendapatkan pelatihan dan keterampilan, perlindungan atas Kesejahteraan Pegawai, perlindungan atas hak mogok dan hak membentuk serikat pekerja dalam membela kepentingan rekan sejawat dan perlindungan atas tindakan PHK.
