PENGGUNAAN TEKNOLOGI INFORMASI DALAM PROSES PERADILAN DI MAHKAMAH SYAR’IYAH

Abstract

Abstract: The use of information technology in the judicial process could improve public service of Religious Courts. However, the response of information technology implementation did not  simultaneously occur in the Religious Courts throughout Indonesia. The aims of this research were to examine the legal arrangements and the use of information technology restrictions on the judicial process in the Sharia Court. Legislation approach method with normative juridical was used in this research. Data was collected by literature review and the data was a secondary data. The results showed that the use of information technology on judicial process in the Sharia Court has been regulated by the Information and Electronic Transaction Law and the Supreme Court Chairman Decree on The Guidelines of Information Services. However, there was no further provision on technical matters in the Sharia Court. Therefore, there was no clear restriction on the use of information technology on the judicial process in the Sharia Court.

Abstrak: Penggunaan teknologi informasi dalam proses peradilan dapat menjadikan pelayanan publik pada Pengadilan Agama menjadi lebih baik. Namun, respon terhadap implementasi teknologi informasi tidak serentak terjadi pada Pengadilan Agama di seluruh Indonesia. Penelitian ini bertujuan untuk mengetahui dan menjelaskan tentang pengaturan hukum dan pembatasan mengenai penggunaan teknologi informasi dalam proses peradilan di Mahkamah Syar’iyah. Metode yang digunakan adalah metode pendekatan perundang-undangan dengan jenis penelitian yuridis normatif. Teknik pengumpulan data dilakukan dengan studi kepustakaan dan sumber data berupa data sekunder. Hasil penelitian menunjukkan bahwa penggunaan teknologi informasi dalam proses Peradilan di Mahkamah Syar’iyah telah diatur oleh Undang-Undang Informasi dan Transaksi Elektronik serta Keputusan Ketua Mahkamah Agung tentang Pedoman Pelayanan Informasi, namun belum ada ketentuan pelaksananya yang bersifat teknis di Lingkungan Mahkamah Syar’iyah sehingga belum ada batasan yang jelas untuk penggunaan teknologi informasi dalam proses Peradilan di Mahkamah Syar’iyah.
