LEGAL PROTECTION FOR VICTIMS OF DEEPFAKE PORN ABUSE IN THE NATIONAL CRIMINAL LAW SYSTEM

Abstract

This study aims to examine the legal framework governing the creation and dissemination of deepfake pornography in Indonesia and to evaluate the adequacy of existing laws in addressing technological advancements in this field. The research employs a normative juridical method by analyzing relevant laws, including Law No. 44 of 2008 on Pornography, Law No. 19 of 2016 on Electronic Information and Transactions (ITE), and Article 407 of Law No. 1 of 2023 on the Indonesian Penal Code (KUHP). The findings reveal that while the current regulations provide a basis for prosecuting offenses related to deepfake pornography, they remain inadequate in addressing the complexities posed by digital technologies. Comparisons with international practices, such as those in the United States, United Kingdom, Australia, and South Korea, suggest the need for a more specific legal framework in Indonesia. The study concludes that improving the legal response requires enhancing the capabilities of law enforcement, developing digital forensic expertise, and harmonizing national regulations with international standards. Recommendations include enacting specific laws on deepfake pornography, promoting technological tools for detection, and fostering international cooperation. These measures aim to ensure justice for victims and strengthen Indonesia’s criminal justice system in the digital era.
