Abstract


This study analyzes the application of the element against the law in the crime of corruption based on the Central Jakarta District Court Decision Number 52/Pid.Sus-TPK/2022/PN.Jkt.Pst. This case involved Albert Burhan, one of the defendants in PT Garuda Indonesia's aircraft procurement, who was convicted under Article 2 paragraph (1) and Article 3 of Law Number 31 Year 1999 on the Eradication of Corruption. The results of the study show that there are differences in the understanding and application of the elements against the law by law enforcers, which leads to inconsistencies in providing legal protection to defendants. This study also highlights that the defendant did not have the authority to make procurement decisions, but was still found guilty, raising questions related to legal certainty. This research uses a normative approach with a descriptive-analytical method, linking positive law theory, the principle of legal certainty, and the business judgment rule. The results reveal the need for revision in the regulation of the unlawful element to ensure justice in law enforcement in Indonesia.
