THE APPLICATION OF INDONESIAN WORKING HOUR LIMIT LAWS TO ON-DEMAND WORKERS IN THE GIG ECONOMY

Abstract


The increasing number of gig workers in Indonesia has created intense competition between app companies. Gig economy has become a solution to earn income with flexible working hours. However, this competition has an impact on the low wages received by gig workers. To achieve a decent income, gig workers often work beyond reasonable time limits. On the other hand, Indonesia does not yet have clear regulations regarding gig workers, so the legal protection and welfare of gig workers are neglected. The question arises of how the regulation of gig workers is regulated in Indonesia and how regulated working hours affect gig workers. This research uses normative juridical methods with statutory and conceptual approaches. It was found that clear legal recognition of gig workers in Indonesia is needed to provide proper legal protection. In addition, the implementation of reasonable working hour policies and minimum wage guarantees can improve the welfare of gig workers and reduce health risks due to excessive working hours. Legal recognition for gig workers in Indonesia is needed to provide legal protection. It is believed that policies that set limits on working hours and guarantee minimum wages are important in order to improve the welfare of gig workers.
