THE EXISTENCE OF THE PRINCIPLE OF PROPORTIONALITY REGARDING HOUSING SALES AGREEMENTS IN MINING AREAS: EXISTENCE AND IMPLICATIONS

Abstract


In the context of economic growth and industrial development, the principle of proportionality plays a crucial role in ensuring balance and fairness among the involved parties, including developers, consumers, and the government. However, the context of mining areas introduces new complexities due to the potential impacts of mining on the environment and communities. This research aims to examine the existence of the principle of proportionality in property sales agreements within mining areas and the potential legal, social, and economic implications that may arise from applying this principle. The research methodology utilized is a normative legal approach, focusing on the analysis of legal regulations, legal principles, and the concept of proportionality in practice. Data was collected through document analysis of legal regulations, court decisions, legal articles, books, journals, and other relevant literature. The research findings indicate that the principle of proportionality is reflected in various aspects, including fair pricing and sales conditions, environmental and health protection, consumer protection, engagement with local communities, fair compensation, and empowerment of the local economy. Legal implications of mismatches between agreements and the principle of proportionality may result in legal disputes, while social implications involve tensions between communities and involved parties. Economic implications encompass potential losses in the local economy and property values
