THE PRINCIPLE OF JUSTICE IN FORMULATION CRIMINAL ACTS AND CRIMINAL LIABILITY ARTICLE 72 OF LAW NUMBER 26 OF 2007 ABOUT SPATIAL PLANNING

Abstract


The formulation of criminal provisions Article 72 of the UUPR regulates criminal provisions for negative behavior, namely not doing something that should be done. In this formulation, there are  primary legal rules, which contain rules about behavior, namely the obligation  to provide access to areas that based on the provisions of laws and regulations are declared as public property and if not committed, the act is a criminal offense. However, the formulation regarding the act is not accompanied by the type of active act and the designation of the nature of "intentional or not" or "conscious or not". This causes injustice, especially during the prosecution of criminal liability. And the criminal liability of people based on criminal acts in Article 72 of the UUPR uses the parameter "there is or is no error". This is based on the principle of no criminal innocence (Geen Straf Zonder Schuld). The elements of guilt consist of: committing a criminal act, being over a certain age and able to be responsible, intentionally or recklessly, and there is no excuse for forgiveness.  So that if there is a violation of the provisions of Article 72 of the UUPR, the perpetrator of the criminal act can be held criminally liable
