APPLICATION OF THE PRINCIPLE OF JUSTICE IN HEALTH POLICY: A STUDY OF THE LEGAL SYSTEM IN INDONESIA

Abstract


This study aims to analyze the extent to which the principle of justice is applied in health policy in Indonesia and identify factors that become obstacles and supporters in its implementation. The method used in this article is normative legal research. The results show that the principle of justice in health policy in Indonesia is manifested through various regulations and programs, such as Law Number 36 of 2009 concerning Health, Law Number 44 of 2009 concerning Hospitals, and the National Health Insurance Program (JKN). The government seeks to ensure equal access to health services for the entire community. However, its implementation still faces obstacles, such as inequality in the distribution of medical personnel, limited infrastructure in remote areas, and financing constraints. On the other hand, strengthening regulations, increasing the budget, and utilizing technology are supporting factors in accelerating the realization of the principle of justice. Therefore, continuous efforts are needed to overcome barriers and strengthen supporting factors to realize a more inclusive and equitable health system.
