UTULIZATION OF ECONOMIC RIGHTS OG COPYRIGHT HOLDERS OVER COPYRIGHTED SONG CREATIONS AS OBJECTS OF FIDUCIARY SECURITY

Abstract


Copyright in songs grants economic rights to the owner, including the possibility of being used as an object of fiduciary guarantee. This research aims to explore the utilization of economic rights in protected songs as objects of fiduciary guarantee, using a normative juridical method and qualitative analysis. The results of the study indicate that although regulated in Article 16 paragraph 3 of the Copyright Law, the utilization of copyright as an object of guarantee has not been fully optimized due to challenges in assessing and executing those rights. Therefore, this study recommends the strengthening of regulations and the assessment mechanism for copyright to support the implementation of fiduciary guarantees.
