DEATH PENALTY ARRANGEMENT IN LAW NO. 1 YEAR 2023 ON CRIMINAL CODE IN RELATION TO RIGHT TO LIFE AND FAIR TRIAL PRINCIPLE

Abstract


Bogor Regency is an area that borders the capital city of Indonesia. This will certainly trigger quite rapid growth. However, this also creates new problems with the emergence of buskers and underage street children who crowd the streets of Bogor Regency. The existence of buskers and street children in Bogor Regency is a factor that makes the author interested in discussing this research. The conclusion from the case analysis based on the Sociological Theory of street buskers and street children is one form of social inequality that occurs in Bogor Regency. Buskers and street children are often found at red light intersections. The proliferation of buskers and street children can have a negative impact, one of which can disturb road users. This also has an impact on the economy of Bogor Regency and also the people themselves. Buskers and street children also have an influence on the orderliness of Bogor Regency. If seen from the Sociological Theory of Law, the cases of buskers and underage street children that occurred in Bogor Regency, it is clear that there is a reciprocity between social and moral society. In this case, the Bogor Regency Government plays a role in controlling buskers and street children. This is also stated in Mochtar Kusumaatmadja's theory, that development carried out by the government can provide protection, education and understanding of religion so that buskers and street children can provide better solutions. Meanwhile, Dumairy's theory explains the government's concern in eradicating buskers and street children. The role of the Bogor Regency government in dealing with beggars and street children is by providing guidance and guidance through the Bogor Regency Social Service.
