SANCTIONS FOR ANIMAL EXPLOITATION CRIMES FROM THE PERSPECTIVE OF ISLAMIC CRIMINAL LAW

Abstract


This study aims to examine sanctions against perpetrators of animal exploitation
crimes from the perspective of Islamic criminal law. Animal abuse is a tyrannical
act that causes suffering, damage, or death to animals for no reason justified by the
Shari'a. In Islam, animals are seen as creatures created by Allah SWT who have
the right to be treated with compassion and justice. This study uses a normative
juridical approach with a descriptive qualitative method through a literature review
of Islamic legal sources such as the Qur'an, Hadith, as well as fiqh literature and
positive legal regulations in Indonesia. The results of the study show that animal
exploitation as a form of abuse is classified as jarimah ta'zir. This study also
compares the Islamic criminal law approach with Indonesia's positive law to
formulate recommendations to strengthen legal protection for animals. Thus, the
results of this study are expected to contribute to a more humane and responsive
legal reform to the issue of animal exploitation and abuse.
