Realizing Indonesia's Legal Readiness for Patents on Inventions Produced Using Artificial Intelligence
Abstract
Paten merupakan salah satu aspek hak kekayaan intelektual yang perlindungannya sangat penting. Namun, penemuan suatu Invensi baru yang diklaim sebagai Invensi oleh DABUS sebagaimana diklaim oleh Dr. Stephen Thaler menimbulkan pertanyaan baru mengenai apakah AI dapat dinyatakan sebagai Inventor untuk permohonan paten. Penelitian ini membahas mengenai kedudukan AI dari perspektif hukum Indonesia, hukum paten di negara lain, dan putusan pengadilan yang relevan. Dari penelitian ini ditemukan bahwa hukum Indonesia tidak mengatur bahwa AI dapat dinyatakan sebagai Inventor dari suatu Invensi. Oleh karena itu, diperlukan perubahan regulasi untuk mengakomodir hal tersebut guna memberikan kejelasan bagi para pemangku kepentingan AI di masa mendatang.
