INDONESIAN CULTURE IN THE NEW CRIMINAL CODE: FROM IUS CONSTITUENDUM TO IUS CONSTITUTUM
Abstract
This research aims to describe and explore the substance of Indonesian legal culture after the ratification of the New Criminal Code. This study seeks to convey the idea of Indonesian legal culture to formulate the New Criminal Code and to analyze the Indonesian legal culture after the ratification of the New Criminal Code. This research method is juridical-normative research focusing on analyzing the legal product in the form of the New Criminal Code. The approach used is the concept and statutory approach. The study results show that the idea of Indonesian legal culture in the effort to formulate a new Criminal Code develops along with the awareness of legal officials and the general public that the substance of the Criminal Code is not following Indonesian legal culture. Therefore, strengthening Indonesia's legal culture in formulating the New Criminal Code has become the main paradigm in reformulating Indonesian criminal law in accordance with the repertoire of Indonesian legal culture. In addition, Indonesia's legal culture after the ratification of the New Criminal Code has substantively been listed and formulated in the New Criminal Code such as efforts to facilitate the existence of customary criminal law, affirmation of sentencing objectives, firm and clear sentencing guidelines so that in addition to reinforcing legal certainty. It is also important for judges in imposing a punishment, as well as the existence of different main types of punishment from the previous Criminal Code such as supervision punishment and social work which are oriented towards applying the concept of corrective justice in Indonesian criminal law.
