PROTECTION OF POTENTIAL GEOGRAPHICAL INDICATIONS OF BENGKULU LOCAL PRODUCTS AS AN EFFORT TO PREVENT ABUSE WITHOUT RIGHTS BY OTHER PARTIES

Abstract

Geographical indication (IG) is a sign indicating the area of origin of goods and/or products which due to geographical environmental factors including natural factors, human factors or a combination of the two factors give reputation, quality and certain characteristics to the goods and/or products generated. In Indonesia the Legislative Regulations concerning Geographical Indications are regulated in Law N0. 20 of 2016 concerning Marks and Geographical Indications. IG needs to get legal protection, not only because it has economic value but also has cultural value, regional and national pride. Protecting Instagram spread throughout Indonesia is not easy. The difficulty lies in the characteristics of a community that is communalistic and does not understand intellectual property law, especially IG. The research method used in this study is empirical juridical. The data used are primary data and secondary data. Primary data was obtained by means of direct interviews with parties related to the handling of research object problems, while secondary data was obtained by means of literature study. The results of this study are the protection of the potential of Geographical Indications carried out by the Bengkulu Provincial Government to protect local products in the perspective of intellectual property law (IPR), especially geographical indications (IG). districts/cities, facilitating the registration of HKI and IG, the Provincial Government continues to coordinate with the Regency/city governments regarding IG socialization, and the only effort that can be made by the community to protect local products is by registering IG. This research is expected to contribute ideas to the community and the Bengkulu Provincial Government to protect local products from the perspective of intellectual property law (IPR), especially geographical indications (IG) and contribute to knowledge in the field of law so that it becomes a reference for similar studies in the future and becomes one of the references, as well as literature in the field of law.
