THE OWNERSHIP STATUS OF BUILDINGS ABOVE INDONESIAN WATERS REVIEWED BASED ON LEGISLATION AND REGULATIONS

Abstract



The maritime areas of Indonesia are utilized by its people for development, including the construction of building structures for business and residential purposes. The issue concerning such development is that many of these building structures above Indonesian waters lack the required permits as stipulated in the legislation and regulations. Furthermore, there is currently no regulation governing the ownership status of building structures above Indonesian waters.The objective of this research is to gain an understanding of the ownership status of building structures above Indonesian waters. The research employs a normative juridical research method, utilizing legal norms found in legislation and regulations. Data collection is conducted through literature review and field research, involving interviews to obtain relevant data. The collected data are analyzed qualitatively.Based on the research findings, it is revealed that the ownership status of building structures in Indonesia has not been specifically regulated in the legislation and regulations. Currently, the establishment of building structures over Indonesian waters requires permits, namely location permits and environmental permits.
