CHILD CUSTODY AND ALIMONY IN THE PERSPECTIVE OF ISLAMIC LAW PSYCHOLOGY IMPLICATIONS FOR THE DEVELOPMENT OF CHILDREN'S PERSONALITIES
Abstract
Child custody (hadhanah) and maintenance obligations are important aspects of Islamic family law that not only have a juridical dimension, but also have a significant impact on the psychological development of children. In the context of divorce, custody disputes and neglect of alimony often have a negative impact on children in the form of emotional disturbances, low self-confidence, and difficulties in forming self-identity. This study aims to analyze the relationship between child custody and alimony from the perspective of Islamic legal psychology and its implications for the development of children's personalities. The method used is normative qualitative research with a descriptive-analytical approach. Data sources include the Qur'an, hadith, Law Number 1 of 1974, the Compilation of Islamic Law (KHI), and developmental psychology literature. The analysis is supported by Bowlby's attachment theory, Maslow's hierarchy of needs, and the concept of tarbiyah in Islamic psychology. The results of the study show that proper custody and adequate maintenance contribute to the formation of emotionally, socially, and spiritually healthy children's personalities. On the other hand, neglecting these aspects poses long-term psychological risks, such as anxiety, feelings of neglect, and potential behavioral deviations. Therefore, the integration of Islamic law and psychology is needed so that the protection of children after divorce is more comprehensive.
