LEGAL CERTAINTY GUARANTEES FOR FOREIGN INVESTORS IN FOREIGN DIRECT INVESTMENT IN INDONESIA: CHALLENGES AND SOLUTIONS

Abstract


Foreign direct investment (FDI) plays a strategic role in Indonesia's economic development. This study aims to analyze the legal certainty guarantees for foreign investors within the framework of investment policies. Using a normative juridical research method, the study evaluates key regulations such as Law Number 25 of 2007 on Investment and the Omnibus Law, as well as their implications for foreign investor protection. The findings reveal that although regulations are designed to create a conducive investment climate, challenges such as regulatory overlaps, corruption culture, complex bureaucracy, and inconsistent law enforcement remain major obstacles. Regulatory reforms and policy harmonization are essential to improve legal certainty, enhance investment competitiveness, and promote sustainable development in Indonesia. This study provides strategic recommendations to enhance legal transparency and efficiency to support foreign investment.
