Hybrid Rule Regulation in Online and Conventional Transportation Arrangements: Realizing The Dignified Justice in Transportation Law

Abstract


Increasingly massive technological developments have led to developments in the field of transportation in the form of online transportation. Online transportation has its own arrangements outside of conventional transportation with the aim of ensuring aspects of legal certainty and benefits in society as a result of the development of online transportation. The discussion of this research focuses on the urgency of formulating a hybrid rule for online transportation and conventional transportation in the perspective of the theory of dignified justice. This research is a normative legal research that uses a concept and statutory approach. The results of the study confirm that the urgency of hybrid rule regulation, namely regulating online and conventional transportation in one legal product, is expected to prevent overregulation which has an impact on overlapping laws and regulations. The idea of hybrid rule regulation or integrated regulation regarding modes of transportation, both online and conventional transportation, has actually fulfilled three orientations in the theory of dignified justice. This is because the presence of hybrid rule regulation is actually oriented so that the ideals of law are to create certainty and justice for society.
