THE DISPARITY IN CONSTITUTIONAL COURT JUDGMENTS ABOUT THE PRESIDENTIAL THRESHOLD IN INDONESIA'S ELECTORAL SYSTEM

Abstract


This study purposes to analyse substantial disparities in Constitutional Court rulings concerning the presidential threshold and the legal implications of these disparities on the electoral system and constitutional practices in Indonesia. The points to be examined are: How does the disparity in Constitutional Court rulings relate to the presidential threshold in Indonesia's electoral system, and what are the legal and constitutional implications of this disparity in rulings on Indonesia's constitutional system and democracy? This study uses a normative juridical approach. The data used in this study consists of primary, secondary, and tertiary legal materials with descriptive qualitative analysis methods. The results of this study are that the disparities in Constitutional Court Decision No. 20/PUU-XX/2022 and Decision No. 62/PUU-XXII/2024 regarding the presidential threshold reflect the complexity of the constitutional debate on the balance between political stability, government effectiveness, and the quality of democracy in Indonesia. These differing rulings have legal implications covering issues of legal certainty, institutional integrity, balance of power, quality of democracy, the legislative process, constitutionalism culture, and the credibility of the judicial system.
