NORMATIVE ASPECTS AND BENEFITS PROTECTION OF GEOGRAPHIC INDICATIONS IN INCREASING THE ECONOMIC VALUE OF REGIONAL PRODUCTS
Abstract
Geographical Indication (GI) protection is an intellectual property law instrument that plays a crucial role in maintaining the reputation, quality, and characteristics of products associated with their region of origin. Normatively, GI protection is regulated by Law Number 20 of 2016 concerning Trademarks and Geographical Indications, which provides a legal basis for producers to protect the identity and uniqueness of their products from counterfeiting or misuse. From an economic perspective, GI protection has been shown to increase product added value through increased selling prices, expanded market access, and strengthened competitiveness at the national and international levels. This study aims to analyze the normative aspects of GI protection in Indonesia and examine the economic benefits arising for regional products that receive such recognition. The research method used is a normative juridical approach with a legislative, conceptual, and case study approach to several GI products such as Gayo Coffee, Kintamani Coffee, and Amed Salt. The results show that GI protection contributes to increasing the economic value of products by 20–50%, expanding market access, and strengthening regional identity. However, its implementation still faces obstacles such as a lack of understanding and awareness among local communities regarding the importance of GI protection and the complexity of GI registration procedures. Based on these findings, it is concluded that Geographical Indication protection in Indonesia needs to be strengthened through increased outreach and legal assistance for producer communities, as well as enhanced inter-institutional coordination, to create an effective GI protection system.
