HUMAN RIGHTS IN LEGAL DEVELOPMENT IN INDONESIA

Abstract


In the science of law, the fundamental concept of human rights highlights how we understand and implement them, while axiology evaluates their benefits and success in contributing positively to legal development and society in Indonesia. Examining these three aspects is crucial to strengthening a legal framework grounded in human rights and ensuring the welfare and justice of all citizens. Several legal issues include: (1) How do epistemological factors in the understanding and interpretation of the law by law enforcement officials affect the effectiveness of law implementation in Indonesia? (2) What is the impact of public legal awareness on the quality of human rights law enforcement in Indonesia to enhance better implementation? These issues are analyzed using a normative-empirical method approach, with Lawrence Meir Freedman's legal substance theory, resulting in research on the ontology of human rights, which refers to the study of the existence and fundamental nature of these rights as inherent attributes of every individual. In this regard, human rights are considered universal principles that must be guaranteed and respected in all legal systems, including in Indonesia, to ensure human dignity is upheld. The epistemology of human rights explores how knowledge about these rights is acquired, understood, and applied within the legal context in Indonesia. This involves steps to integrate international standards and local norms into the national legal framework, enabling human rights knowledge to be effectively accepted and implemented by society and the government. The axiology of human rights in the perspective of legal development in Indonesia focuses on the values and objectives of implementing these rights in the formation and enforcement of laws. Axiology emphasizes the importance of utilizing human rights to advance social justice, reduce inequality, and ensure the protection of citizens' rights without discrimination.
